Subseries 5. Professional and Civic Work

Scope and Content Notes:

Thornburgh continues to participate in and lead numerous professional and civic undertakings. The first for which files were available are as follows: Henry J. Stimson Center (Board of Directors); Allegheny County Home Rule Committee (Honorary Chairman); National Academy of Public Administration, Chair (NAPA); Legal Policy Advisory Board of the Washington Legal Foundation (Chairman); Task Force on the Future of Shared State and Federal Securities Regulation; U.S. Securities and Exchange Commission's proceedings against John G. Black, Devon Capital Management Services, Inc. and Financial Management Sciences, Inc.; and "A Republican Case for United Nations Funding," project of the Emergency Coalition for U.S. Financial Support of the United Nations.

Subsequent files added to the collection in 2013 are: Internet Child Pornography, World Bank, Inter-American Development Bank, WorldCom Bankruptcy, Ethics, Dan Rather “60 Minutes Wednesday,” Board of Science Applications Investigation of Greek Contract Issues, Russian Federation vs Bank of New York, Freeh Report regarding Paterno, FBI Transformation Panel, FBI Director’s Advisory Board, Gettysburg Foundation Board, Terrorism Task Force, and Attorney-Client Privilege.

The above additions in 2013 vary in extent of documentation from a simple report or statement to files that cover many years as a task force leader. The variety of subject matter and responsibility well represent Thornburgh’s continuing legal and political acumen and high regard.

Section: Internet Child Pornography

Scope and Content Notes:

While Attorney General Thornburgh worked hard for the passage of the Child Protection and Obscenity Enforcement Act of 1988 and set forth Justice Department priorities to vigorously prosecute child pornography and obscenity by specialists in each U.S. attorney’s office and a national effort against producers and distributors of illegal hard-core videos. In 2002 he chaired the National Research Council committee on how to deal with the explosion of inappropriate sexually explicit material available to young people on the Internet. The resulting report was described by the New York Times as “one of the most thorough…on protecting children from Internet pornography” although it pointed out the absence of a “quick fix.”

Section: World Bank

Scope and Content Notes:

In 1999, World Bank President Jim Wolfensohn asked Thornburgh to examine the bank’s mechanisms to deal with fraud and corruption connected to its lending. Estimates that as much as 25 percent of its funding found its way into pockets of corrupt officials eventually were recognized by the bank as a great concern rather than merely “political” reality. Thornburgh with the help of some former associates from the Department of Justice and the United Nations learned about the culture of the bank and figured out methods to address the problem. The resulting report delivered in early 2000 recommended a new Office of Institutional Integrity which was up and running within months. They continued to act as consultants to the bank on the implementation of the recommendations.

Section: WorldCom Bankruptcy

Scope and Content Notes:

In August 2002, the U.S. Bankruptcy Court in the Southern District of New York appointed Thornburgh the examiner in the case filed by WorldCom, one of the world’s largest telecommunications companies. This was a “sorry tale of corporate wrongdoing” (Evidence, p. 362). Thornburgh put together a team, with whom to undertake what he described a “massive task.” “My job was to carry out an independent investigation into what happened in the WorldCom matter and to assure Bankruptcy Judge Arthur Gonzales that procedures and persons involved in any past wrongdoing were not carried forward into any reorganized entity… and finally to make recommendations to aid in avoiding repetition elsewhere of the acts that caused the downfall of WorldCom” (Evidence, p. 363). The three committee reports over several years place major responsibility for WorldCom’s collapse on the members of the board of directors, especially those who served on its audit and compensation committees. Major officials involved in the fraud were convicted in federal court.

Scope and Content Notes:

WorldCom and other corporate debacles and wrongdoing that were subsequently uncovered produced many legislative and regulatory responses. These included the Sarbanes-Oxley Act of 2002 and other regulations to avoid similar instances of corporate corruption. This section relates to relationships between corporations and their lawyers, and responsibilities, compensation, and liabilities of boards of directors. Thornburgh ultimately concluded that ethical conduct of corporate affairs would make more difference than all the laws and regulations and spoke often and wrote articles to this effect. The files date between 2003 and 2006.

Section: Dan Rather "60 Minutes Wednesday"

Scope and Content Notes:

Not long after the WorldCom matter was completed, Thornburgh was called by CBS News President Andrew Heyward, on September 21, 2004. He asked if Thornburgh would undertake an independent investigation with Associated Press CEO Lou Boccardi into preparation of the September 8 broadcast relating to the Texas Air National Guard Service of President George W. Bush, and public statements by CBS News following and defending the segment. This was extremely sensitive due to the proximity of the 2004 presidential election so work began immediately. The investigation revealed serious shortcomings. Ultimately Dan Rather relinquished his anchor position on the CBS Evening News and Mary Mapes and other senior individuals were terminated and/or resigned. Ultimately CBS News adopted all the recommendations in the final report which had received much public and news attention.

Scope and Content Notes:

A bizarre case involving U.S. Racketeer Influenced and Corrupt Organizations (RICO) statute took Thornburgh to the legal scene in the Russian Federation in 2008. In May 2007 a civil case was initiated in Moscow against Bank of New York Mellon. The complaint sought damages of $22.5 billion from the bank under the U.S. RICO statue. The bank’s defense counsel engaged a number of experts in U.S. law to testify on its behalf, including Thornburgh, who went to Moscow and did testify, a copy of which is included here.

Section: Freeh Report, re: Paterno

Scope and Content Notes:

Thornburgh was asked by the Paterno family to perform an independent and objective review of the “Freeh Report” regarding the University’s response to child abuse charges and its references to Paterno. The ensuing report entitled “Review of the Freeh Report Concerning Joseph Paterno” is dated February 6, 2013 and describes the Freeh Report as seriously flawed.

Section: FBI Transformation Panel

Scope and Content Notes:

One of the constructive by-products of the dreadful 9/11 attacks was a top-to-bottom review of law enforcement and intelligence agencies, which included the Federal Bureau of Investigation. Thornburgh chaired this major review at the request of the National Academy of Public Administration (NAPA) of FBI’s Director Bob Mueller‘s plans to make necessary improvements in the Bureau’s processes and practices. This was an active and detailed process that extended from 2006-2010. There were several reports and multiple testimonies involved and are included here.

Section: FBI Director's Advisory Board

Scope and Content Notes:

The FBI Transformation Panel reports were generally positive about Mueller’s plan to modernize and update the FBI. Mueller asked Thornburgh in August 2005 to serve on the FBI Director’s Advisory Board which had been authorized by Congress in February 2003 to independently advise the Director on matters relating to science, technology, research and other matters of special interest to the FBI. Also the transformation panel recommendations were seen as critical to put in place. Thornburgh served on the board 2005-2011.

Section: Gettysburg Foundation Board

Scope and Content Notes:

The mission of the Foundation is to provide greater appreciation of the Gettysburg Campaign and consequences of the American Civil War. Goals and accomplishments included restoring the battlefield and presenting significant exhibits and programs to visitors. Thornburgh served on the foundation board for a number of years beginning in 2000.

Section: Terrorism Task Force

Scope and Content Notes:

Thornburgh was asked to be a member of the Terrorism Task Force in October 2001. The purposes were to identify issues where careful thought is required and that occur in early days of a great crisis. Major issues for the task force were to relate to an International/National Agenda, Homeland Security, and US & World Economy. Thornburgh was a member briefly October 2001 into fall 2002, when other significant challenges for him ensued.

Scope and Content Notes:

Thornburgh was appointed by the American Bar Association to the Task Force on Attorney-Client Privilege in 2006. The files extend to August 2010 at the time of the Final Report. They include meeting agendas and minutes, Congressional testimony, and other background information. This subject was said to concern “grave dangers” to attorney-client privilege which is described as a fundamental element of the American system of justice.
